To all those who adopt our plushies, this page to guarantee you that we are the only depositary of the mark, the logo and the design of the octopus plushies as you attest it the copies below and this for a duration of 5 years in all the countries of the European Union.

We are proud of the work we do, we are happy that you like our stuffed animals and this page is intended to inform you and to avoid, at least we hope, that you buy similar stuffed animals, often of bad quality, and very often that you never receive, as our after-sales service testifies daily: we are not responsible for similar stuffed animals sold elsewhere and there is no partnership Mon-Octopus with other e-commerce sites.

Article L716-9
Is punished by four years imprisonment and a fine of 400   euros for any person, with a view to selling, supplying, offering for sale or renting goods presented under a counterfeit trademark :
a) Importing, exporting, re-exporting or transhipping goods presented under an infringing trademark ;
b) To produce industrially goods presented under an infringing mark ;
c) To give instructions or orders for the commission of the acts referred to in a and b.

When the offenses provided for in this article have been committed in organized gang or on a network of communication to the public online or when the facts relate to goods dangerous to health, safety of humans or animals, the penalties are increased to seven years of imprisonment and to 750,000 euros of fine.

Article L.716-10
Is punished by three years’ imprisonment and a fine of 300   euros for any person :
a) To hold without legitimate reason, to import or export goods presented under an infringing mark ;
b) Offering for sale or selling goods presented under an infringing mark ; 
c) Reproduce, imitate, use, affix, remove or modify a trademark, collective mark or collective certification mark in violation of the rights conferred by its registration and the prohibitions deriving therefrom ;
(d) knowingly deliver a product or provide a service other than that for which it is requested under a registered trademark. The offence, under the conditions provided for in d, is not constituted in the case of the exercise by a pharmacist of the right of substitution provided for in article L. 5125-23 of the Public Health Code.
When the offences provided for in a) to d) have been committed in an organized gang  or on a network of communication to the public on line, the penalties are increased to seven years imprisonment and a fine of 750,000 euros.
